Law signed by the President - KSeF postponed to Feb. 1, 2026

Law signed by the President – KSeF postponed to February 1, 2026

/
Date17 Jun 2024

On June 5, the president signed an amendment to the VAT Act, which postpones the mandatory implementation of the National System of e-Invoices (KSeF) to February 1, 2026. This means that until that date, the rules for issuing invoices will remain unchanged.
The law of May 9, 2024, amending the Goods and Services Tax law and other laws, was published in the Official Gazette on June 10 and will enter into force on July 1, 2024.

Further legislative changes

The Ministry of Finance has decided to divide the legislative work on amending the KSeF Act into two parts in order to give companies the opportunity to better familiarize themselves with the proposed changes and to conduct extensive consultations.
In the second draft law, the Ministry of Finance will present proposals for simplifications related to the implementation of KSeF and will propose a phased introduction of mandatory KSeF:

  • From February 1, 2026, for entities whose turnover value (including taxes) exceeded 200 million PLN in 2025.
  • From April 1, 2026, for other entities.

Production version of the KSeF Mobile Application

Despite the postponement of the mandatory e-invoicing deadline in KSeF, the Ministry of Finance continues to work on providing free tools for using the system. A production version of the KSeF Mobile Application has been made available, which enables the issuance of basic invoices and corrections on smartphones. The application also allows viewing invoices received and issued in KSeF and is available on Google Play Store and the App Store.
