The new implementation date of the National System of e-Invoices (KSeF)

The Ministry of Finance, in a press briefing attended by Finance Minister Andrzej Domański and the head of the National Revenue Administration, Marcin Łoboda, announced the new implementation dates for the National System of e-Invoices (KSeF).

The National System of e-Invoices will be mandatory from:

  • February 1, 2026 – for companies that achieved turnover above 200 million PLN in the previous tax year
  • April 1, 2026 – for all other entrepreneurs.

A key factor influencing the determination of the new effective date of KSeF was the outcome of the system audit. Minister Domański expressed the opinion that it will be necessary to start work on the KSeF system from scratch. “The 350-page audit leaves no illusions that a paralysis of the Polish economy was looming. This paralysis was caused by actions or the lack of adequate actions by our predecessors. The technical analysis showed a failure to meet quality and performance requirements. Invoice issuance tests did not even come close to the expected performance,” he conveyed.

The information about the new mandatory implementation date of the National System of e-Invoices is particularly important for entrepreneurs, accountants, and IT companies. Some entrepreneurs have already begun preparations to meet the obligatory invoicing requirements, which means that currently used systems will need to be adjusted to the new version of KSeF. Marcin Łoboda, head of the National Revenue Administration, emphasized that they will strive to interfere as little as possible with the systems of those entrepreneurs who have already started preparations.

According to the current wording of the law, the obligation to issue structured invoices using the National System of e-Invoices is to come into force on July 1, 2024. Therefore, Deputy Finance Minister Jarosław Neneman announced a quick change of the date in the KSeF act, while the law itself is to be processed and referred to consultation at a later date.
